1. Introduction
Welcome to Absolutely Shades Ltd, a New Zealand-registered company providing residential and commercial moving services across Aotearoa. These Terms of Service (“Terms”) form a legally binding agreement between you (“Client”, “you”) and Absolutely Shades Ltd (“we”, “us”, “our”) and govern your use of our services. By engaging our services, either through our website, phone, email, or in-person, you agree to be bound by these Terms.
2. Definitions
- Services: All moving-related activities including packing, loading, transporting, unloading, storage, and logistics.
- Client: The person or business contracting or using the services.
- Property: Items, belongings, or goods subject to moving or handling.
3. Service Area
We operate across New Zealand, including Waikato, Auckland, Wellington, Christchurch, Dunedin, Tauranga, and rural regions. Remote areas may involve additional charges or longer timeframes.
4. Bookings & Estimates
- Quotes are estimates and may change if conditions differ on the day.
- All estimates are in NZD and include GST unless stated otherwise.
- Bookings are confirmed upon receipt of deposit or written approval.
- We may decline a booking for safety or compliance reasons.
5. Payment Terms
- Full payment is due at service completion unless otherwise arranged.
- We accept EFTPOS, bank transfer, and major cards.
- Overdue payments may incur interest and debt collection costs.
6. Cancellations & Changes
- 48+ hours’ notice: full refund
- Under 48 hours: up to 25% fee
- After arrival/service begins: no refund
7. Your Responsibilities
- Provide accurate and complete information
- Ensure safe, legal access at both sites
- Pack properly unless packing service arranged
- Disclose hazardous or valuable items in advance
8. Property Condition & Damage
We are not liable for:
- Customer-packed item damage
- Pre-existing or structural damage
- Minor cosmetic wall/floor marks
Claims must be made within 7 days. Liability is limited to $0.60/kg unless otherwise agreed.
9. Insurance & Risk
Basic carrier liability is included. We strongly advise third-party transit insurance for high-value items. Storage is at your own risk unless insured.
10. Force Majeure
We are not liable for service failure or delay due to events beyond our control, including natural disasters, road closures, or pandemics.
11. Third-Party Services
We may use subcontractors or partners for part of your move. While we choose reliable providers, we are not liable for their actions or terms.
12. Privacy & Data
We comply with the Privacy Act 2020. Your data is used only for service, communication, billing, and compliance. See our Privacy Policy for more.
13. Consumer Guarantees & Legal Compliance
Our services comply with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Business clients waive CGA rights unless stated.
14. Indemnification
You agree to indemnify us against claims or losses caused by your actions, omissions, or breach of these terms.
15. Dispute Resolution
We aim to resolve disputes amicably. If unresolved, they will be governed by New Zealand law and heard in the courts of Waikato, NZ.
16. Amendments
These Terms may be updated. Your continued use implies acceptance of changes. The latest version is always published on our website.
